Key Compliance Deadlines for Brokers to Remember in Q4

Table Of Contents

Q4 doesn’t slow down for compliance deadlines. If anything, it speeds up. Renewal season, open enrollment, and year-end planning all compete for attention at exactly the moment several compliance deadlines come due.

Helping clients keep those dates on their radar is one of the clearest ways a broker can stand out as a true advisor rather than just a point of contact.

Here’s a roundup of key Q4 deadlines to keep on your radar.

Oct. 15, 2026 — Extended Form 5500 Filing Deadline (Calendar-year Plans Only)

Employers with calendar-year plans that applied for the automatic 2.5-month filing extension must file Form 5500 with the DOL by Oct. 15, 2026.

Nov. 2, 2026 — Q3 Form 941 Filing

Employers must file Form 941 to report federal income tax, Social Security tax, and Medicare tax withheld from employee pay during the third quarter. The due date is normally Oct. 31, but since that date falls on a weekend in 2026, the deadline shifts to the next business day, Nov. 2.

Dec. 31, 2026 — Gag Clause Attestation

Employer-sponsored health plans and health insurance issuers must submit attestations of compliance with the prohibition on gag clauses by Dec. 31 each year, through a CMS website. If the issuer for a fully insured plan provides the attestation, the health plan does not also need to.

Dec. 31, 2026 — End of Q4

While not a single filing deadline, the close of the quarter, and the year, is an important checkpoint for employers to:

  • Complete any outstanding annual performance reviews
  • Confirm required workplace employee training will be completed on time
  • Encourage employees to submit a new Form W-4 for 2027 if their personal or financial situation has changed
  • Confirm annual nondiscrimination testing has been completed for applicable benefit plans
  • Remind employees about unused FSA, HRA, and PTO balances before they’re forfeited

Utilizing resources like Zywave’s Client Cloud can assist with all these tasks, including automated alerts that ensure important dates stay top of mind and helpful templates and checklists.

Why These Deadlines Matter for Brokers

For brokers, Q4 is a critical period for reinforcing compliance support, especially as it overlaps with renewal season and year-end planning. Timely reminders can help employers avoid costly penalties, reduce administrative stress, and close out the year with accurate records. By proactively communicating these deadlines, you can strengthen your role as a trusted advisor and demonstrate year-round value beyond renewal season.

Staying Ahead of Compliance Year-round

Compliance is a moving target, and Q4 brings some of the most consequential deadlines of the year, arriving right alongside renewals. By staying informed and helping clients prepare, brokers can play a key role in reducing risk and supporting smooth operations heading into the new year.
