AI Governance in Insurance: Why Compliance Is Now a Boardroom Priority

AI governance used to be a back-office conversation, something for the compliance team to sort out after the fact. These days, however, as carriers, MGAs, and agencies deploy AI across underwriting, claims, and distribution, regulators, courts, and boards are asking the same question: who’s accountable when an AI system gets it wrong? Knowing where insurance AI compliance stands in 2026 has now become a strategic necessity.

Why Insurance AI Compliance Has Become a Board-Level Issue

The scale of the exposure is a big part of why this has moved up the org chart. Gartner projects that more than 2,000 legal claims tied to AI-related harm will be filed worldwide by the end of 2026.

The same source also notes that by 2030, P&C insurers will require organizations to demonstrate strong AI risk controls before granting affirmative AI liability coverage, a shift that could drive a 60% increase in AI governance and security investment. This is a subtle sign that how well-governed your AI program is will soon shape your risk profile the same way loss history already does.

The State vs. Federal Friction Shaping AI Governance Insurance Rules

The regulatory picture itself is still being built in real time. The NAIC’s Model Bulletin on the Use of Artificial Intelligence Systems by Insurers, first adopted in December 2023, has now been formally adopted by roughly half of U.S. states, with several more moving through their own regulatory processes.

States that adopt the bulletin expect insurers to maintain a documented AI governance program that tests for bias, monitors outcomes, and holds senior management or a board-level committee accountable for the results. Meanwhile, federal and state AI rules are developing on separate tracks, and multistate carriers are responding by governing to the highest common bar rather than waiting for a single national standard to emerge.

Why Governing Agentic AI Is a Different Kind of Compliance Challenge

Most existing governance frameworks were built with a static model in mind, one whose behavior could be tested once and monitored on a schedule. Agentic AI works differently: a system that researches, decides, and acts without approval at every step produces an ongoing chain of decisions rather than a single output to check. Governing it well means documenting what the model is authorized to do on its own, where a human stays involved, and how the team monitors its actions over time.

At Zywave’s Sept. 10 AI Exchange event, a panel of industry experts discussed the topic, noting that as AI adoption accelerates, inherent risks remain in place. “It comes back to what clients should be asking themselves: how much has this model actually been tested, and what’s the acceptable failure rate?” Cate Rooney, Head of Commercial Underwriting at Vault Insurance, noted.

“Technology companies have dealt with this for years — they have an acceptable amount of uptime or downtime, and AI governance isn’t so different. Organizations have gotten much more sophisticated about vendor management over time, reviewing how tech vendors protect client data. With AI, you just have to take that evaluation to an even higher level.”

Governance is often seen as the thing standing between an organization and faster AI adoption. In reality, it’s usually the opposite. A documented, tested AI governance program gives a carrier or agency the clarity to move faster with AI, because it can explain how a given outcome was reached. In a market moving this fast, the organizations that treat responsible AI governance as core infrastructure are the ones best equipped to keep scaling and growing.
